Car Wash Membership Terms of Service: Wild Water Express Car Wash

Membership Subscription

By subscribing to our Car Wash Membership, you authorize Wild Water Express Car Wash to automatically charge your credit card each month on the anniversary date of your initial purchase. This subscription will continue until properly canceled by the member.

Consent to Automatic Renewal

By enrolling, you authorize Wild Water Express Car Wash to charge your selected payment method on a recurring basis at the disclosed price and frequency until you cancel. You acknowledge that the automatic renewal terms are presented prior to enrollment in a clear and conspicuous manner and that you affirmatively consent to them at the time of purchase.

After enrollment, we will send you a confirmation/acknowledgment (for example, by email and/or account receipt) that includes the automatic renewal terms, the cancellation policy, and instructions for canceling in a manner you can retain.

All membership changes (including cancellations, plan changes, and billing inquiries) must be submitted through the official Wild Water Express online member portal. Cancellations may be completed online at any time and will stop future renewals and you will receive a confirmation. Your membership will remain active through the end of the then-current paid billing period. You will receive an on-screen confirmation and an email confirmation when your cancellation is processed. After you receive cancellation confirmation, we will not bill you for future renewal periods unless you re-enroll.

If a membership is canceled mid-billing cycle, the member will retain full access to their membership benefits through the end of the current paid billing period. No prorated refunds or credits will be issued except where required by law, or to correct a verified billing error (for example, duplicate charges or charges after a confirmed cancellation).

It is the customer’s responsibility to ensure cancellations are completed correctly and submitted through the proper channels. Failure to complete the cancellation process and receive confirmation may result in renewal charges. Refunds or credits will be issued only as required by law or to correct a verified billing error.

Refund Policy

All membership fees are non-refundable and no credits will be issued for unused washes, partial billing periods, weather conditions, temporary closures, equipment downtime, vacations, vehicle issues, or lack of usage. Exceptions: we may issue a refund or credit only (i) as required by law, or (ii) to correct a verified billing error.

Billing, Payment Failures, and Chargebacks

You authorize us to charge your selected payment method for recurring membership fees and applicable taxes until you cancel. If a payment fails, we may reattempt the charge, suspend membership access until payment is successfully processed, and require you to update your payment method before service resumes. If you believe a charge is in error, you agree to contact Customer Success first so we can investigate and resolve the issue. Initiating a chargeback or payment dispute may result in temporary suspension of membership benefits during the investigation. If a chargeback is decided in our favor, we may re-bill the amount owed to restore the account to good standing. We do not charge additional fees without your approval in the portal, except for applicable taxes and any fees permitted by law for returned or failed payments. If your payment method is charged back, reversed, or invalidated for a renewal period you received access to, you remain responsible for the amount due.

SMS and Email Communications

As a member, you may opt-in to receive promotional alerts, updates, and important communications via SMS and email. By opting in, you consent to receive automated messages to the phone number and email address you provided. Frequency of messages may vary, and message and data rates may apply. Consent to receive SMS messages is not a condition of purchase. You can opt-out at any time by replying “STOP” to SMS messages or using the unsubscribe link in emails.

Privacy Policy

We are committed to protecting your privacy. We collect and use personal information (such as contact information, payment-related information, and vehicle information) to administer memberships, provide services, communicate with you, prevent fraud, and comply with legal obligations. We may share personal information with service providers that help us operate the program (for example, payment processing, membership management, customer communications, security, and fraud prevention) and with professional advisors as needed, consistent with our Privacy Policy. We do not sell personal information.

Changes and Cancellations

Members can manage their accounts online to discontinue, pause, or change plans (limit one membership level change per 90 days) and update payment information. Changes and cancellations are effective for stopping future renewals within 7 business days upon submission and confirmation; membership remains active through the end of the current paid billing period.

To protect your account, you are responsible for submitting cancellation requests through the online portal and ensuring you receive a cancellation confirmation. If the portal is unavailable or you are unable to complete cancellation online, contact our Customer Success Center and we will assist. Wild Water Express is not responsible for renewal charges where a cancellation request was not successfully submitted and confirmed due to incorrect account information, failure to authenticate, or incomplete submission.

Wild Water Express Car Wash reserves the right to modify, suspend, or cancel memberships, pricing, or benefits at any time as permitted by law, including for suspected fraud or misuse, nonpayment, safety or operational concerns, or if required by law or regulation.

Terms and Conditions

Membership is valid for ONE vehicle only, is non-transferable, and is valid during normal business hours. The membership is tied to the vehicle identified in your account. You may update vehicle information in the portal. Vehicle updates may be limited and may require verification. Frequent vehicle changes may be treated as suspected misuse and may result in suspension pending review. Sharing, transferring, plate swapping, or attempting to use the membership on more than one vehicle is prohibited and may result in immediate termination without refund and/or suspension pending investigation.

Memberships can only be purchased with major credit/debit cards. Cash and bank transfers will not be accepted.

We reserve the right to close, limit access, or modify hours due to weather, equipment maintenance, staffing limitations, safety concerns, or special events.

Temporary or permanent changes to hours, availability, or service levels do not qualify for refunds or credits.

Rates, benefits, and these Terms may change from time to time. If we make a material change to the automatic renewal terms (including a price increase), we will provide clear and conspicuous notice and information on how to cancel in a manner you can retain (for example, by email and/or within your online account) before the change takes effect. If you do not agree to the change, you may cancel before it applies to avoid future renewal charges.

Site Monitoring and Fraud Prevention

For safety, operational integrity, and fraud prevention, our locations may use video monitoring and/or vehicle identification methods (including license plate recognition where used). By using the membership, you consent to such monitoring and identification for these purposes.

Vehicle Condition, Customer Responsibilities, and Damage Claims

You are responsible for ensuring your vehicle is safe to wash and for following all posted instructions and attendant directions. Do not use the wash if your vehicle has unsecured parts, non-factory modifications, loose trim, damaged paint, prior body damage, roof racks or accessories that are not wash-safe, oversized tires/wheels, low clearance, or any condition that could be affected by water, brushes, conveyors, dryers, or chemicals. We are not responsible for damage caused by pre-existing vehicle conditions, aftermarket parts or modifications, ordinary wear and tear, or failure to follow posted instructions. You are responsible for removing or securing external accessories (including antennas, flags, magnets, loose emblems, wiper blades, and temporary attachments) and confirming your vehicle meets posted size, clearance, and equipment requirements.

If you believe the wash caused damage, you must notify an on-site manager before leaving the property (or, if not reasonably possible, within 24 hours) and provide photos, the date/time, and your receipt or membership details. Failure to provide prompt notice and a reasonable opportunity to inspect the vehicle may affect our ability to investigate the claim.

Disclaimer of Warranties

Services are provided on an “AS IS” and “AS AVAILABLE” basis. To the maximum extent permitted by law, we disclaim all warranties, express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

Limitation of Liability

To the maximum extent permitted by law, in no event will Wild Water Express be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages. To the maximum extent permitted by law, Wild Water Express’s total liability for any claim arising out of or relating to the membership will not exceed the total membership fees paid by you to us in the three (3) months immediately preceding the event giving rise to the claim. Without limiting the foregoing, we will not be liable for loss of use of a vehicle, diminished value, loss of time, inconvenience, or substitute transportation costs.

Indemnification

You agree to indemnify, defend, and hold harmless Wild Water Express and its owners, officers, employees, agents, and affiliates from and against any claims, damages, liabilities, losses, costs, and expenses (including reasonable attorneys’ fees) arising out of or related to your misuse of the membership, violation of these Terms, fraud, plate/vehicle swapping, sharing/transfer, or unlawful conduct.

Informal Dispute Resolution

Before filing a claim, you agree to contact Customer Success with a description of the issue and allow 30 days for us to try to resolve it. This does not prevent either party from seeking relief in small claims court.

Governing Law / Venue

These Terms are governed by the laws of the State of California, without regard to conflict-of-law rules. Any dispute not subject to arbitration (if applicable) shall be brought in the state or federal courts located in California, and the parties consent to personal jurisdiction and venue there.

Severability

If any provision of these Terms is held unenforceable, the remaining provisions will remain in full force and effect.

Entire Agreement

These Terms, together with any referenced policies provided at enrollment or in the member portal, constitute the entire agreement between you and Wild Water Express regarding the membership and supersede all prior or contemporaneous understandings.

No Reliance / No Oral Modifications

You agree that you have not relied on any verbal statements or promises not expressly stated in these Terms. No employee or agent may modify these Terms except in a written update issued by Wild Water Express.

No Waiver

Failure to enforce any provision of these Terms is not a waiver of our right to do so later.

Assignment

We may assign these Terms and our rights and obligations under them without notice. You may not assign these Terms without our prior written consent.
